2.4.1 NEWSLETTER

The following information explains the contents of our newsletter as well as the registration, dispatch and statistical evaluation procedures and your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedures described.

Content of the newsletter

We send newsletters, e-mails and other electronic notifications with promotional information (hereinafter "newsletter") only with the consent of the recipients or a legal permission. Insofar as the contents of the Newsletter are specifically described in the context of a registration, they are decisive for the consent of the users. In addition, our newsletters contain information product news and offers.

Subscriptions to the newsletter are logged in order to be able to prove the subscription process in accordance with legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address. Likewise, the changes to your data stored with MailChimp are logged.

Use of the dispatch service provider "MailChimp".

The newsletter is sent using "MailChimp", a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients, as well as their other data described in the context of this notice, are stored on MailChimp's servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to address them itself or to pass them on to third parties.

We trust in the reliability and IT and data security of MailChimp. MailChimp is certified under the US-EU data protection agreement "Privacy Shield" and thus undertakes to comply with EU data protection requirements. Furthermore, we have concluded a "Data Processing Agreement" with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to pass it on to third parties. You can view MailChimp's privacy policy here.

Registration data

To register for the newsletter, it is sufficient to enter your email address, first and last name.

Statistical collection and analyses

The newsletters contain a so-called "web beacon", i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are collected. This information is used for the technical improvement of the services based on the technical data or the target groups and your reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or the access times.

Statistical surveys also include determining whether newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our endeavor nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Online call and data management

There are cases where we direct newsletter recipients to MailChimp's websites. For example, our newsletters contain a link that newsletter recipients can use to retrieve the newsletters online (e.g., in case of display problems in the email program). Furthermore, newsletter recipients can subsequently correct their data, such as the e-mail address. Likewise, the privacy policy of MailChimp is only available on their site.

In this context, we pointed out that cookies are used on the websites of MailChimp and thus personal data is processed by MailChimp, their partners and service providers used (e.g. Google Analytics). We have no influence on this data collection. You can find more information in the privacy policy of MailChimp. We would also like to draw your attention to the options for objecting to the collection of data for advertising purposes on the websites http://www.aboutads.info/choices/ and http://www.youronlinechoices.com/ (for the European region).

Cancellation/revocation

You can cancel the receipt of our newsletter at any time, i.e. revoke your consents. This will simultaneously terminate your consents to its dispatch via MailChimp and the statistical analyses. A separate revocation of the dispatch via MailChimp or the statistical analysis is unfortunately not possible.

You will find a link to cancel the newsletter at the end of each newsletter. You can also unsubscribe at any time by informing us of this wish by message via email, chat or on the phone. After unsubscribing, we will delete your e-mail address unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement.

Legal basis Data Protection Regulation

In accordance with the requirements of the Basic Data Protection Regulation (DSGVO) applicable as of May 25, 2018, we inform you that the consent to send e-mail addresses is based on Art. 6 Para. 1 lit. a, 7 DSGVO and § 7 Para. 2 No. 3, or Para. 3 UWG. The use of the dispatch service provider MailChimp, implementation of statistical surveys and analyses as well as logging of the registration process, are carried out on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f DSGVO. Our interest is focused on the use of a user-friendly and secure newsletter system that serves our business interests and meets the expectations of users.

2.4.2 PRODUCT RECOMMENDATIONS BY E-MAIL

E-mail advertising without newsletter registration and your right to object

If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right, on the basis of Section 7 (3) of the German Unfair Competition Act (UWG), to regularly send you offers by e-mail for similar products to those you have already purchased from our range. This serves to protect our legitimate interests in addressing our customers in an advertising manner, which are outweighed in the context of a balancing of interests. You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic rates.

2.4.3 INDIVIDUAL ADVERTISING FOR YOU

Information that we receive from you helps us to permanently improve your shopping experience and to make it customer-friendly and individual for you. The information you provide and automatically generated is used to design advertising tailored to you and your interests. We use existing information for this purpose, such as confirmations of receipt and reading of e-mails, information about computer and connection to the Internet, operating system and platform, your order history, your service history, date and time of your visit to the homepage, products you have viewed. We use this information exclusively in pseudonymized form. By analyzing and evaluating this information, it is possible for us to improve our websites and our Internet offering, as well as to send you individualized advertising as a result. This means advertising that recommends products to you that you might actually be interested in. Our goal is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the pseudonymized data collected from you helps us to ensure that we do not send you advertising indiscriminately. Rather, we send you advertisements, such as newsletters, product recommendations, via email or postal mail, that correspond to your areas of interest. In this respect, we also compare, for example, which of our promotional emails you open in order to avoid sending unnecessary emails to you. Alphanf uses the data I provide and other information stored about my customer account, as well as pseudonymized usage data, to present me with personalized advertising and/or special offers and services. If you do not want to receive personalized advertising, you can object to this at any time in total or for certain measures. A notification in text form to the contact details mentioned under point 1 (e.g. e-mail, fax, letter) is sufficient for this.

2.4.4 COMPETITIONS, MARKET AND OPINION RESEARCH

In the case of competitions, we use your data for the purpose of prize notification and advertising for our offers. Detailed information can be found in our terms and conditions of participation for the respective competition. We also use your data for market and opinion research. Of course, we only use this data anonymously for statistical purposes. Your answers to surveys will not be passed on to third parties or published. Alphanf uses and processes my personal data for market and opinion research for its own purposes. You can object to the use of your data for market and opinion research at any time, either in full or for specific measures. A notification in text form to the contact data mentioned under point 1 (e.g. e-mail, fax, letter) is sufficient for this purpose. Of course, you will also find an unsubscribe link in every survey e-mail.

3. CREDIT CHECK

Only after explicit consideration of your interests do we carry out a credit check before concluding the purchase contract. This is done to protect us against default in payments on account and by direct debit. In addition, the credit check serves your and our security, as this prevents fraud and other crimes. As part of the credit check, we check all the data available to us and thus determine which payment methods can be offered for an order. Among other things, all previous orders in your customer account are checked. In addition, we also check whether the delivery address differs from the billing address, whether it is a new delivery address or whether the order should be delivered to a packing station. In addition to the data we have, data from external service providers is also required. For this purpose, we transmit the personal data required for a credit check (first name and surname, your address and, if applicable, your date of birth) to one or more service providers. Your date of birth) to one or more of the following creditworthiness service providers: infoscore Consumer Data GmbH, Rheinstraße 99, 76532 Baden-Baden - SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden - Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden - Arvato Finance A/S, Østbanegade 55, 2. tv, DK-2100 København Ø - Financial Tech Sweden AB, Mäster Samuelsgatan 42, 111 57 Stockholm. This creditworthiness service provider uses the aforementioned data transmitted by us to make a corresponding assessment of your creditworthiness with regard to the respective order on the basis of mathematical-statistical procedures (scoring). Furthermore, the creditworthiness service provider uses the aforementioned data for other companies (e.g. other online retailers) for the purpose of address verifications or identity checks as well as for scoring applications based on this. Your address data is also included in the calculation of the probability value. Under certain circumstances, it may be possible to draw conclusions about hard negative characteristics. As part of the ordering process, we also compare your bank details (only IBAN and BIC or account number and bank code) with the Return-debit Prevention Pool (RPP) of infoscore Consumer Data GmbH (ICD), Rheinstr. 99, 76532 Baden-Baden. The RPP has the function of a blocking file. In addition, in the event that the direct debit is not honored, we will, to the extent permitted, enter your bank details (IBAN and BIC only, no personal details) in the RPP of ICD, which will transmit this blocking to other companies involved in the information procedure upon request. After payment of the returned debit note, we will report the settlement in the RPP. If you do not agree with the payment method(s) offered to you, you can notify us in writing by letter or by email to kontakt@alphanf.com. We will then reconsider the decision taking into account your point of view. You can both revoke your consent at any time with effect for the future to us in writing or in text form to kontakt@alphanf.com and obtain information about the stored data from us and from our credit rating service provider (at the above addresses).

4. COOKIES

Accepting cookies is not a requirement to visit our websites. However, please note that our website and service will have limited functionality if you do not allow us to set cookies.

What are cookies? Cookies are small files that are stored on your data carrier and that store certain settings and data for exchange with our system via your browser. Basically, there are 2 different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period of time or indefinitely. This storage helps us to design our web pages and our offers for you accordingly and makes it easier for you to use them, for example, by storing certain entries made by you in such a way that you do not have to keep repeating them.

What cookies does Alphanf.com use? Most of the cookies we use are automatically deleted from your hard drive at the end of the browser session (end of session) (hence session cookies). Session cookies are needed, for example, to offer you the shopping cart function across multiple pages. In addition, we also use cookies that remain on your hard drive. During a further visit, it is then automatically recognized that you have already been with us and which inputs and settings you prefer. These temporary or permanent cookies (lifetime 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies in particular serve to make our offer more user-friendly, more effective and safer. Thanks to these files, it is possible, for example, for you to receive information on the site that is specifically tailored to your interests. The exclusive purpose of these cookies is to adapt our offer to your customer wishes in the best possible way and to make your surfing with us as comfortable as possible.

What data is stored in the cookies? Only pseudonymous data is stored in the cookies used by Alphanf. When the cookie is activated, it is assigned an identification number and no assignment of your personal data to this identification number is made. Your name, IP address or similar data that would allow the cookie to be assigned to you are not placed in the cookie. Based on the cookie technology, we only receive pseudonymized information, for example, which pages of our store were visited, which products were viewed, etc.

What is onsite targeting? On the Alphanf websites, data is collected on the basis of cookie technology to optimize our advertising and the entire online offer. This data is not used to identify you personally, but is used solely for a pseudonymous evaluation of the use of the homepage. At no time will your data be merged with personal data stored by us. This technology allows us to present you with advertisements and/or special offers and services whose content is based on information obtained in connection with clickstream analysis (for example, advertisements based on the fact that only sports shoes have been viewed in the last few days). Our goal in doing so is to make our online offering as attractive as possible to you and to present you with advertisements that match your areas of interest.

Are there also cookies from third-party providers (so-called third-party cookies)? Alphanf uses some advertising partners that help to make the Internet offer and the websites more interesting for you. Therefore, when you visit the websites, cookies from partner companies are also stored on your hard drive. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies (lifetime 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time. The cookies of our partner companies also contain only pseudonymous, mostly even anonymous data. This is, for example, data about which products you have viewed, whether something was purchased, which products were searched for, etc.. In this regard, some of our advertising partners also collect information beyond the websites about which pages you have previously visited or which products you were interested in, for example, in order to be able to show you advertising that best matches your interests. This pseudonymous data will not be merged with your personal data at any time. The sole purpose is to enable our advertising partners to address you with advertising that might actually interest you.

Re-targeting Our websites use so-called re-targeting technologies. We use these technologies to make our website more interesting for you. This technology makes it possible to address Internet users who are already interested in our store and our products with advertising on the websites of our partners. We are convinced that the display of personalized, interest-related advertising is usually more interesting for the Internet user than advertising that has no such personal reference. The insertion of these advertisements on the pages of our partners is based on cookie technology and an analysis of previous user behavior. This form of advertising is completely pseudonymous. No usage profiles are merged with your personal data. By using our site, you consent to the use of so-called cookies and thus to the collection, storage and use of your usage data. Furthermore, your data will be stored in cookies beyond the end of the browser session and, for example, can be accessed again during your next visits to the website. You can revoke this consent at any time with effect for the future by refusing to accept cookies in your browser settings.

How can you prevent the storage of cookies?

In your browser, you can set that cookies are only accepted if you agree to this. If you only want to accept Alphanf cookies but not the cookies of our service providers and partners, you can select the setting in your browser "Block third-party cookies". You will usually be shown how to reject new cookies and turn off cookies you have already received via the help function in the menu bar of your web browser. Detailed information on how to make the settings in the browser you use is available at the following link. We recommend that if you use shared computers that are set to accept cookies and Flash cookies, you always log out completely when you are finished.

5. LOG FILES

Each time the pages of Alphanf are accessed, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The data records stored in this process contain the following data: Date and time of access, name of the page accessed, IP address, referrer URL (origin URL from which you came to the web pages), the amount of data transferred, as well as product and version information of the browser used. The IP addresses of the users are deleted or anonymized after termination of use. In the case of anonymization, the IP addresses are changed in such a way that the individual information about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person, or can only be assigned to such a person with a disproportionate amount of time, cost and effort. We evaluate these log file data records in anonymized form in order to further improve our offer and the Alphanf store and make it more user-friendly, to find and correct errors more quickly and to control server capacities. For example, we can understand at what time the use of the Alphanf store is particularly popular and provide appropriate data volume to ensure you the fastest possible shopping. In addition, by analyzing the log files, we can also detect and correct any errors in the Alphanf store more quickly.

6. WEB ANALYTICS

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. A transfer of this data by Google to third parties only takes place due to legal regulations or within the framework of order data processing. Under no circumstances will Google merge your data with other data collected by Google. By using this website, you consent to the processing of data about you by Google and the manner and purpose of data processing described above. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our website. You can also prevent the collection of data generated by the cookie and related to your use of these web pages (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available under the following link. 6.3 CRITEO

On our websites, anonymized information about the surfing behavior of website visitors is collected and stored for marketing purposes by a technology of Criteo GmbH. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page. Our website uses social plugins ("plugins") from various social networks. With the help of these plugins, you can, for example, share content or recommend products. The plugins are deactivated by default on alphanf.com and therefore do not send any data. You can activate the plugins by clicking on the "Activate social media" button. The plugins can of course be deactivated again with one click. When these plugins are activated, your browser establishes a direct connection with the servers of the respective social network as soon as they call up a web page of our website. The content of the plugin is transmitted directly to your browser by the social network and integrated into the website by it. By integrating the plugins, the social network receives the information that you have accessed the corresponding page of our website. If you are logged in to the social network, it can assign the visit to your account. If you interact with the plugins, for example by clicking the Facebook "Like" button or posting a comment, the corresponding information is transmitted from your browser directly to the social network and stored there. For the purpose and scope of the data collection and the further processing and use of the data by social networks, as well as your rights in this regard and setting options for protecting your privacy, please refer to the privacy notices of the respective networks or websites. You can find the links to this below. Even if you are not logged in to the social networks, websites with active social plugins can send data to the networks. An active plugin sets a cookie with an identifier each time the website is called up. Since your browser sends this cookie with every connection to a network server without being asked, the network could in principle use it to create a profile of which websites the user belonging to the identifier has called up. And it would then also be quite possible to assign this identifier to a person again later - for example, when logging on to the social network later. We use the following plugins on our websites: Facebook, Twitter and Pinterest If you do not want social networks to collect data about you via active plugins, you can either simply deactivate the social plugins by clicking on our websites or select the "Block third-party cookies" function in your browser settings. Then the browser will not send cookies to the server for embedded content from other providers. However, with this setting, in addition to the plugins, other cross-page functions may no longer work.

8.2 FACEBOOK

We use plugins of the social network facebook.com, which is operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). You can find the link to Facebook's privacy policy here: Facebook Privacy Policy.

8.3 TWITTER

We use plugins of the social network Twitter, which is operated by Twitter Inc, 795 Folsom St, Suite 600, San Francisco, CA 94107, USA ("Twitter"). You can find the link to Twitter's privacy policy here: Twitter Privacy Notice.

8.4 PINTEREST

9. SOCIAL SIGN IN

We offer you the option to register directly with us using your existing Facebook profile. If you want to use this function, you will first be redirected to Facebook. There you will be asked to log in with your username and password. Of course, we do not take any notice of your login data. If you are already logged in to Facebook, this step will be skipped. Facebook will then tell you which data will be transmitted to us (public profile, friends list, email address and current place of residence). You confirm this by clicking the "OK" button. With the transmitted data we create your customer account, whereby your friends list is of course not stored by us. A permanent link between your customer account and your account on Facebook does not take place. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as your rights in this regard and settings options for protecting your privacy, can be found in Facebook's privacy policy.
